We have created this Privacy Policy as part of our Terms of Business to explain what information we collect, how it is collected, processed and how we may share it with relevant third parties.

“We” refers to Prosper Limited, together with the company employees, directors, officers, affiliates, and subsidiaries. 
“You” refers to you as the candidate or client registered with us in order to use our services. 
“Information” refers to all the different forms of data with which you provide us and which we collect from you in the course of our duties in order to render you service. 

Information We Collect: Clients 

We collect limited personal information when working with our clients to find them candidates for their roles. This will usually be limited to contact details for our point(s) of contact within the client business such as name, telephone number(s) and email address(es). The focus of our discussions with clients is on the type of candidate, skillset, renumeration for a role, as opposed to requiring individual personal or sensitive personal information. 

Information We Collect: Candidates 

With the candidates registered with us looking for roles, we do have to collect a range of personal data, and at times sensitive personal data, in order to support them. 

If you are a person looking to register with us then there is certain information that we will ask you to ordinarily provide when you register with us to use our services. 

This information will include: 

  1. Personal Data – your first and family names, date of birth, address, email address, phone number(s), Social Security and Tax numbers and employment and housing status.  

  2. Educational Qualifications – details of qualifications gained  

  3. Educational and Employer References  

How We Use Your Information 

To create your candidate pack and enter your data on our secure database after obtaining your consent. 

To transfer your candidate pack to prospective employers via the client’s chosen secure portal after obtaining your consent. 

If you no longer wish to remain on our database, you may contact us to unsubscribe in writing to laura@prosper.je 

How We Share and Disclose Your Personal Information 

With prospective employers via the client’s chosen secure portal, after obtaining your consent. 

Security 

We, and our service providers, take stringent precautions – including administrative, technical and physical measures – to safeguard your personal information against loss, theft and misuse, as well as against unauthorised access, disclosure, alteration, and destruction. 

We follow generally accepted industry standards to protect your information, both once we receive it and during onward transmission. 

Correcting, Accessing, Updating and Deleting Information 

If you wish to access the information which you have provided or obtain confirmation on the information being held about you, you may contact us by email or letter in order to request us to do this. We will respond to your request within 21 days. We may decline to process unreasonable requests or requests which are not otherwise required under the Data Protection (Jersey) Law 1998. 

If you wish to delete the information which you have provided, you may contact us by email or letter in order to request us to do this. We will respond to your request immediately or within 21 days. 

If you wish to modify or rectify any incorrect or incomplete information which you have provided, you may contact us by email or telephone or letter in order to request us to do this. We will respond to your request within 21 days. 

Retention of Information 

We retain your personal information and data in your candidate pack referred to above for five years. This is to ensure we have the information available should you require this information for a future role.  

Legitimate Interest 

When finding or searching for a new candidate, either independently or on behalf of a client, through a publicly-available channel such as website, social media network or job board, this sourcing is deemed to constitute legitimate interest on behalf of the recruiter/client as a reasonable expectation of contact would exist. In such cases, the only data which would be processed prior to contact with the candidate is the profile, and no data is stored before contact has been made. If the candidate does not respond to the initial contact or specifically asks not to be contacted, then the profile is deleted. 

On occasions, our clients may ask us to produce statistical data about the individuals who applied for particular roles, for example to monitor diversity. If we are asked to do this, such information will be collated in a statistical format and on an anonymous basis.

This privacy policy may be changed by us at any time. If we change this privacy policy in the future, we will set out these changes clearly so that you will always know what personal information we gather, the purposes for which it may be used and shared, and to whom we may disclose it.
